Welcome to Naviya! These Terms of Service ("Terms") govern your access to and use of the Naviya adaptive learning platform ("Service"). By accessing or using Naviya, you agree to be bound by these Terms. If you do not agree, please do not use our Service.

1. Acceptance of Terms

By creating an account or using Naviya, you confirm that:

• You are at least 11 years old (or the minimum age in your jurisdiction)
• If you are under 18, you have parental or guardian consent
• You have the legal capacity to enter into these Terms
• You will comply with all applicable laws and regulations
• All information you provide is accurate and truthful

2. Account Registration and Security

2.1 Student Accounts

• Students register using their phone number and OTP verification
• You must provide accurate grade, board, and subject information
• You are responsible for maintaining the confidentiality of your account

2.2 Parent Accounts

• Parents register using email and password
• You may link to your children's accounts with their consent
• You must keep your password secure and confidential

2.3 Account Responsibility

You are responsible for all activities under your account. Notify us immediately if you suspect unauthorized access. We are not liable for losses from unauthorized use of your account.

3. Acceptable Use

3.1 You May:

• Access and complete lessons in your selected subjects
• Earn XP, unlock achievements, and participate in gamification
• Add friends and compete on leaderboards
• Customize your profile and preferences
• Monitor your progress and analytics

3.2 You May NOT:

• Share your account credentials with others
• Create multiple accounts to manipulate leaderboards or achievements
• Use bots, scripts, or automation to complete lessons or earn XP
• Harass, bully, or abuse other users through the friends system
• Post inappropriate, offensive, or harmful content
• Attempt to hack, reverse engineer, or compromise the platform
• Scrape, copy, or redistribute our content without permission
• Use the Service for any illegal or unauthorized purpose
• Impersonate others or provide false information

4. Intellectual Property

4.1 Our Content

All content on Naviya (lessons, questions, explanations, graphics, logos, software) is owned by Naviya or our licensors and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

4.2 Your Content

You retain ownership of content you create (profile information, answers, posts). By using Naviya, you grant us a license to use, store, and display this content to provide the Service.

5. Service Availability and Modifications

We strive to provide reliable service, but:

• The Service is provided "as is" without warranties of any kind
• We may experience downtime, outages, or technical issues
• We may modify, suspend, or discontinue features at any time
• We may update content, curriculum, or difficulty algorithms
• We are not liable for service interruptions or data loss

6. Free Service

Naviya is currently 100% free for all students and parents. We reserve the right to introduce premium features in the future, but core learning features will remain free. We will provide advance notice of any changes to our pricing model.

7. Termination

7.1 By You

You may delete your account at any time through Profile Settings. Upon deletion, your data will be removed within 30 days as described in our Privacy Policy.

7.2 By Us

We may suspend or terminate your account if you:

• Violate these Terms of Service
• Engage in fraudulent or abusive behavior
• Compromise the security or integrity of the platform
• Use the Service for illegal purposes

We will provide notice when possible, but may terminate immediately for serious violations.

8. Privacy

9. Parent-Child Linking

Parents may link to their children's accounts to monitor progress:

• Linking requires the student's consent (entering their linking code)
• Parents can view progress, XP, streaks, lessons completed, and activity
• Parents cannot access the student's account or complete lessons on their behalf
• Students may unlink from parents at any time in Privacy Settings

10. Gamification and Virtual Items

Naviya includes gamification features (XP, gems, achievements, leaderboards, shop):

• Virtual items (XP, gems, power-ups, cosmetics) have no real-world monetary value
• We may adjust XP values, achievement criteria, or shop prices at any time
• Leaderboard rankings are based on XP and may be reset periodically
• We reserve the right to remove achievements or items obtained through violations
• Virtual items cannot be transferred, sold, or redeemed for cash

11. Community Conduct

When interacting with other users (friends, leaderboards), you must:

• Be respectful and kind to others
• Not harass, bully, or threaten anyone
• Not share inappropriate or offensive content
• Report violations to our support team
• Respect others' privacy and personal information

Violations may result in warnings, friend restrictions, or account termination.

12. Disclaimer of Warranties

NAVIYA IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Accuracy or completeness of content
• Educational outcomes or academic performance improvement
• Uninterrupted or error-free service
• Security or absence of viruses
• Fitness for a particular purpose

Naviya is a supplementary learning tool and does not replace formal education.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NAVIYA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF YOUR USE OR INABILITY TO USE THE SERVICE.
